Why am I only able to spectate on some games?

I noticed that a few games I am unable join but it allows me to spectate. This is for AoC. I am not outside of the game room rating range and the host is not ignoring me. The only thing I could think of is that the game is friends-only, but I don't see that option for non-premium members.

Any idea why this is happening?
